Placing an order implies the customer's full and unreserved acceptance of these General Terms and Conditions. - Modification of the General Conditions of Sale:
BeLiving reserves the right to modify these Terms and Conditions at any time. The new Terms and Conditions will be effective as soon as they are posted online and will apply to orders placed after they are posted online. - Intellectual Property:
All elements of the beliving.shop website, whether visual or audio, are protected by copyright, trademarks, or patents. They are the exclusive property of BeLiving. Any reproduction, exploitation, redistribution, or use of the website's elements, whether software, visual, or audio, is strictly prohibited. - Contract Language:
The contract is written in French. In the event of translation into another language, the French text shall prevail. - Products:
The products offered for sale are those listed on the beliving.shop website on the day the user visits the site. Product offers are valid while stocks last. In the event that a product is unavailable, BeLiving will inform the customer as soon as possible. - Price :
9.1 Fixing and changing prices:
BeLiving reserves the right to modify its prices at any time, with the understanding that the price listed in the catalog on the day the order is placed will be the only price applicable to the buyer. Promotions and discounts will be clearly indicated on the website.
9.2 Specific conditions applicable to consumers residing in France:
Prices are listed in euros, all taxes included (TTC), excluding delivery charges. In accordance with Article 293 B of the French General Tax Code, VAT is not applicable.
9.3 Specific conditions applicable to consumers residing in Mexico:
Prices are listed in Mexican pesos, all taxes included (TTC), excluding shipping costs. The products offered on beliving.shop are shipped from a foreign country and sold by a company with no legal entity or tax presence in Mexico. Consequently, no Mexican value-added tax (VAT) is charged upon ordering, and no invoice compliant with Mexican tax regulations (CFDI) will be issued.
It is the buyer's responsibility to check any customs obligations applicable to imports into their country. Any customs duties, local taxes, or import fees that may be payable by the Mexican authorities will remain the sole responsibility of the customer.
9.4 Specific conditions applicable to consumers residing in Colombia:
Prices are listed in Colombian pesos, all taxes included (TTC), excluding shipping costs. The products offered on beliving.shop are shipped from a foreign country and sold by a company with no legal entity or tax presence in Colombia. Consequently, no Colombian value-added tax (IVA) is charged upon ordering, and no invoice compliant with Colombian tax regulations will be issued.
It is the buyer's responsibility to check any customs obligations applicable to imports into their country. Any customs duties, local taxes, or import fees that may be payable by the Colombian authorities will remain the sole responsibility of the customer.
9.3 Specific conditions applicable to consumers residing in Panama:
Prices are quoted in Panamanian balboas, inclusive of all taxes (TTC), excluding delivery charges. Consequently, no Panamanian value-added tax (ITBMS) is charged when ordering, and no invoice compliant with local tax regulations will be issued.
It is the buyer's responsibility to check any customs obligations applicable to imports into their country. Any customs duties, local taxes, or import fees that may be payable by the Panamanian authorities will remain the sole responsibility of the customer.
9.4 Specific conditions applicable to consumers residing in the Philippines:
Prices are listed in Philippine pesos, inclusive of all taxes (VAT), excluding delivery charges. As a result, no local VAT (Value-Added Tax) is charged when ordering, and no invoice compliant with the Philippine Bureau of Internal Revenue (BIR) will be issued.
It is the buyer's responsibility to check any customs obligations applicable to imports into their country. Any customs duties, local taxes, or import fees that may be payable by the Philippine authorities will remain the sole responsibility of the customer.

Any order placed on the beliving.shop website implies full and unreserved acceptance of these General Terms and Conditions. - Payment Terms:
Payment is made online by credit card or any other payment method indicated when ordering. The order will be considered effective after confirmation of the agreement of the bank payment centers. - Delivery :
12.1 Specific conditions applicable to consumers residing in France:
12.1.1 Delivery Address:
According to Article L.216-1 of the French Consumer Code, BeLiving must deliver the goods in accordance with the sales contract. Products ordered on our website beliving.shop are delivered to the address provided by the customer when ordering. It is the customer's responsibility to provide an accurate and complete delivery address. Any errors or omissions in the delivery address are their responsibility.
BeLiving cannot be held responsible for errors or omissions in the information provided by the customer and will not be responsible for the delivery of the order or any resulting delivery delays. In this case, the customer will assume responsibility for the error, including any additional costs associated with reshipping or returning the package.
If the package is lost or untraceable due to an error in the address provided by the customer, BeLiving will not be required to resend or refund. If the customer wishes to resend the package, they will need to place a new order, including the cost of the product and shipping fees.
BeLiving undertakes to inform the customer of the delivery failure due to the address error.
Pursuant to Article L.221-15 of the French Consumer Code, the customer is informed of the importance of verifying the accuracy of the delivery address when confirming the order. A confirmation of the delivery address will be sent to the customer when confirming the order.
For any complaints or address corrections, the customer must contact BeLiving customer service before shipping the order. BeLiving will not be liable for any indirect losses or damages resulting from an address error.
12.1.2 Delivery Time:
The delivery times indicated are purely indicative and do not constitute a firm commitment on the part of BeLiving, unless a specific deadline has been explicitly agreed between the two parties in writing, in accordance with Article L. 216-1 of the French Consumer Code. In the absence of a specific indication, delivery will be made within a maximum of 35 days from the order confirmation, in accordance with Article L. 216-1 of the French Consumer Code.
For products ordered for events with a fixed date (such as holidays, birthdays, or other special occasions), BeLiving cannot guarantee mandatory delivery unless explicitly agreed in writing. In the event of a delay, the customer will not be able to claim compensation or invoke a time limit, unless a clause to the contrary has been agreed in advance.
In the event of a delay in delivery, i.e. of more than 35 days, the customer must inform BeLiving either:
-By email, preferably using the email address used when ordering the product at contact@beliving.shop or directly via the contact form by clicking on “Contact us” at the top of the page.
-By registered letter with acknowledgment of receipt. BeLiving will launch an investigation with the carrier to determine the causes of the delay. If delivery is not made at the end of a reasonable additional period (generally set at 14 days after the initial period) granted by the customer, the latter may, in accordance with Articles L. 216-2 and L. 216-3 of the Consumer Code, terminate the contract either:
-By email, preferably using the email address used when ordering the product at contact@beliving.shop or directly via the contact form by clicking on “Contact us” at the top of the page.
-By registered letter with acknowledgment of receipt.
12.1.3 Reimbursement for Late Delivery:
When a customer requests and receives a refund due to a late delivery, the sales contract is considered terminated. The refund will be made using the same payment method used when ordering, unless explicitly agreed otherwise between BeLiving and the customer. In accordance with Article L. 216-3 of the French Consumer Code, this refund will be made within fourteen (14) days following the request for termination.
12.1.4 Receipt of the Package after Reimbursement:
If the product is delivered after the customer has been refunded, the customer is required to inform BeLiving. Retaining the package without notification could be considered undue receipt of the goods, in accordance with Article L. 121-20-4 of the French Consumer Code.
12.1.5 Force Majeure and Customs Delays:
BeLiving cannot be held responsible for delays or non-delivery in the event of force majeure, including, but not limited to, natural disasters, strikes, pandemics, civil unrest, armed conflicts, administrative decisions, or any unforeseeable and irresistible event making it impossible to fulfill the order. Delays due to customs controls are also considered force majeure, in accordance with Article 1218 of the French Civil Code relating to force majeure.
In the event of a customs delay, BeLiving undertakes to inform the customer as soon as possible, ideally within 7 days of becoming aware of the situation. It is important to note that these delays can occur unpredictably and are beyond BeLiving's control.
During the entire period of force majeure, BeLiving's obligations are suspended, and the customer will not be able to demand compensation.
12.1.6 Additional Charges:
The prices displayed on our website include applicable VAT unless otherwise stated. However, additional charges such as customs duties and customs processing fees may apply. These charges are in addition to the sales price and VAT and will be collected by the customs authorities or the carrier at the time of delivery.
We strongly recommend that consumers check the customs and tax regulations in force in their country before placing an order, to avoid any surprises upon receipt of products. To do this, we invite you to consult your government's official websites or inquire with your local customs authorities.
12.1.7 Verification of Delivery:
Upon receipt of the order, the customer must imperatively check the condition of the packaging and the conformity of the products. In the event of damage or missing items, the customer must inform the carrier of their reservations and inform BeLiving within 3 working days of receipt, either:
-By email, preferably using the email address used when ordering the product at contact@beliving.shop or directly via the contact form by clicking on “Contact us” at the top of the page.
-By registered letter with acknowledgment of receipt. In accordance with Article L. 133-3 of the French Commercial Code, it must indicate visible damage and/or missing items on the delivery slip.
12.2 Specific conditions applicable to consumers residing in Mexico:
12.2.1 Shipping Delays and Loss of Packages – Disclaimer:
The products sold on the BeLiving store are shipped from abroad. Due to the absence of a physical presence or legal entity in Mexico, the company is not subject to the provisions of the Federal Consumer Protection Law (LFPC) regarding delivery times and guaranteed receipt.
BeLiving cannot be held responsible for any errors in the delivery address provided by the consumer. Any loss, delay, or non-delivery resulting from incorrect information is the sole responsibility of the consumer.
The delivery times indicated when ordering are provided for informational purposes only. No contractual commitment is made regarding a fixed delivery date. Consequently, no refund, compensation, or cancellation of the order may be required in the event of delay or loss of the package, except in exceptional circumstances at the sole discretion of the seller.
12.3 Specific conditions applicable to consumers residing in Colombia:

The products sold on the BeLiving store are shipped from abroad. Due to the absence of a physical presence or legal entity in Colombia, the company is not subject to the provisions of Law 1480 of 2011 regarding delivery times and guaranteed receipt.
BeLiving cannot be held responsible for any errors in the delivery address provided by the consumer. Any loss, delay, or non-delivery resulting from incorrect information is the sole responsibility of the consumer.
The delivery times indicated when ordering are provided for informational purposes only. No contractual commitment is made regarding a fixed delivery date. Consequently, no refund, compensation, or cancellation of the order may be required in the event of delay or loss of the package, except in exceptional circumstances at the sole discretion of the seller.
12.4 Specific conditions applicable to customers residing in Panama:

12.5 Specific conditions applicable to customers residing in Panama:
12.5.1 Shipping Delays, Package Loss and Claims – Disclaimer:

The delivery times indicated when ordering are provided for informational purposes only. No contractual commitment is made regarding a fixed delivery date. 13.1 Specific conditions applicable to consumers residing in France:
13.1.1 Exemptions to the right of withdrawal for purchases of goods related to professional, commercial and entrepreneurial activities:
The right of withdrawal is reserved exclusively for consumers (natural persons who purchase goods for purposes unrelated to their professional, commercial or entrepreneurial activity). This right cannot therefore be exercised by entrepreneurs (legal entities and natural persons acting for purposes related to their professional activity).
13.1.2 Right of Withdrawal in France:
In accordance with Article L. 221-18 of the French Consumer Code, the consumer has a right of withdrawal of fourteen (14) days from receipt of his order to return the products, without having to justify his decision, nor to bear costs other than those provided for in Article L. 221-23 of the French Consumer Code. This legislation guarantees you the right to return the purchased product and to obtain reimbursement of the expenses incurred.
When the order is made up of several packages containing separate products, the withdrawal period begins from the receipt of each product.
However, in the case of an order comprising a single product shipped in several separate packages, the right of withdrawal begins upon receipt of the last package.
13.1.3 Exceptions to the Right of Withdrawal:
In accordance with Article L. 221-28 of the Consumer Code, the right of withdrawal cannot be exercised for the following contracts:
- Personalized goods (goods made to the consumer's specifications or clearly personalized).
-Perishable goods (goods likely to deteriorate or expire quickly, such as food).
- Sealed products (products that have been unsealed by the consumer after delivery and which cannot be returned for reasons of hygiene or health protection, e.g. cosmetics, underwear).
- Recordings and software (audio, video recordings or computer software when unsealed by the consumer after delivery).
-Newspapers and periodicals (the supply of newspapers, periodicals or magazines, except for subscription contracts to these publications.
-Digital content (supply of digital content not supplied on a physical medium when performance has begun after the consumer's express prior agreement and express waiver of his right of withdrawal).
13.1.4 Customer responsibility: Conditions of withdrawal.
The consumer is liable for any diminished value of the goods resulting from handling other than that necessary to establish the nature, characteristics and proper functioning of the products, namely:
-The right of withdrawal only applies to products in their entirety
-The returned product must be received in the same conditions as when received, new and unused, in a normal state of conservation.
-Complete with all its parts (accessories, instruction manuals etc).
-Complete in its original packaging, which is an integral part of its value.
If these conditions are not respected, BeLiving reserves the right to refuse the return.
13.1.5 Notification of withdrawal:
To exercise his right of withdrawal, the consumer must notify his decision to BeLiving within fourteen (14) days of receipt of his order by an unambiguous declaration either:
-By email, preferably using the email address used when ordering the product at contact@beliving.shop or directly via the contact form (by clicking on “Contact us” at the top of the page) and preferably using the template available below (13.1.6)
-By registered letter with acknowledgment of receipt.
In order to facilitate the processing of the request and to verify the condition of the product, the customer is required to provide:
-Proof of purchase
-Photographic evidence of the product's condition. Photos must show that the product meets the conditions stated above (a general overview of the product, close-ups of specific parts, the label or any other relevant details such as the serial number, model, etc.) and be sent in one of the following formats: JPEG, JPG, or PNG, with a clear resolution and a total weight not exceeding 20 MB.
This requirement is to ensure that the product is in good condition and complies with the return conditions.
The notification of withdrawal, proof of purchase and proof (photos) of product conformity guarantee must be sent to BeLiving jointly before the end of the fourteen (14) day period.
Any incomplete withdrawal request will be considered invalid by BeLiving; it is the consumer's responsibility to provide all necessary information within the given time frame.

13.1.7 Return of the product:
Within 3 working days of receiving your withdrawal request, BeLiving will send the consumer:
- Either a return authorization as well as return instructions if the product complies with the requirements of the right of withdrawal.
- Either a notification of refusal of return if the product does not comply with the requirements of the right of withdrawal.
-Or request the return of the withdrawal request if the present request is incomplete.
After receiving the return authorization and the shipping address, the consumer has an additional fourteen (14) days to return the product at their own expense. The shipping of the product as well as the shipping conditions (packaging, transport, etc.) are the consumer's responsibility. We recommend using a shipping method that allows the return to be tracked and the product to be insured, to avoid any loss or damage during transport.
13.1.8 Return costs:
The cost of returning the product is the responsibility of the consumer in accordance with Article L. 221-18 of the Consumer Code.
13.1.9 Method and time limits for reimbursement:
BeLiving will reimburse all payments within fourteen (14) days from the date on which it became aware of the consumer's right of withdrawal, including delivery costs with the exception of additional costs resulting from the choice of a type of delivery other than the least expensive standard delivery type (not to be confused with return costs, which are, as a reminder, the responsibility of the consumer). The reimbursement will be made by the same payment method used when ordering, unless explicitly agreed otherwise between BeLiving and the consumer.
Beliving may withhold reimbursement until it has received the product in full or until the customer has demonstrated that they have returned the goods, whichever comes first.
13.1.10 Supplier's right of withdrawal:
BeLiving has the right to withdraw from a sales contract within 30 days from the order date, providing the customer with a simple and reasoned notification, in cases where the ordered product is temporarily unavailable or circumstances make the execution of the contract impossible under normal conditions. In this case, the customer will have the exclusive right to be reimbursed for any amount already paid.
13.2 Specific conditions applicable to consumers residing in Mexico:
13.2.1 Absence of right of withdrawal:
The company operating the BeLiving store is located outside of Mexico and has no registered office, establishment, or legal entity there. Consequently, the Federal Consumer Protection Law (LFPC) does not apply to transactions made on beliving.shop.
It is expressly stipulated that the right of withdrawal provided for by the said law does not apply. By validating his order, the buyer expressly acknowledges having read this provision and accepts that any request for return, refund or exchange is excluded, except in exceptional cases taken at the sole discretion of the seller.
13.3 Specific conditions applicable to consumers residing in Colombia:
13.3.1 Absence of right of withdrawal:
BeLiving is established outside Colombian territory and has no registered office, establishment, or legal entity there. Consequently, Law 1480 of 2011 – Estatuto del Consumidor Colombiano does not apply to transactions made on beliving.shop.
It is expressly stipulated that the right of withdrawal provided for by the said law does not apply. By validating his order, the buyer expressly acknowledges having read this provision and accepts that any request for return, refund or exchange is excluded, except in exceptional cases taken at the sole discretion of the seller.
13.4 Specific conditions applicable to customers residing in Panama:
13.4.1 Absence of right of withdrawal:
The company operating the BeLiving store is located outside of Panamanian territory and has no registered office, establishment, or legal entity there. Consequently, Law 45 of 2007 – Consumer Protection and Competence Law does not apply to transactions conducted on this site.
It is expressly stipulated that the right of withdrawal provided for by the said law does not apply. By validating his order, the consumer expressly acknowledges having read this provision and accepts that any complaint or request for a solution remains entirely subject to the assessment and discretion of the seller.
13.5 Specific conditions applicable to customers residing in the Philippines:
13.5.1 Absence of right of withdrawal:
The company operating the BeLiving store is located outside the Philippines and has no registered office, place of business, or legal entity in the Philippines. Therefore, Republic Act No. 7394 – Consumer Act of the Philippines does not apply to transactions conducted on this site.
It is expressly stipulated that the right of withdrawal provided for by the said law does not apply. By validating his order, the consumer expressly acknowledges having read this provision and accepts that any complaint or request for a solution remains entirely subject to the assessment and discretion of the seller.
- Conditions Specific to Certain Products or Services:
Certain products or services may be subject to specific conditions. These specific conditions will be indicated on the relevant pages of the site. In the event of any discrepancy between these T&Cs and the specific conditions, the latter shall prevail. - Archiving and Proof:
BeLiving will archive purchase orders and invoices on a reliable and durable medium constituting a faithful copy, in accordance with the provisions of Article 1379 of the Civil Code. BeLiving's computerized records will be considered by all parties concerned as proof of communications, orders, payments and transactions between the parties. - Customer Service:

17.1 Specific conditions applicable to consumers residing in France:
17.1.1 Legal Guarantee of Conformity:
In accordance with Articles L. 217-4 et seq. of the French Consumer Code, the consumer benefits from the legal guarantee of conformity. If the product presents a lack of conformity, the consumer is entitled to the repair or replacement of the product, provided that it is returned to BeLiving. The legal guarantees of conformity do not apply to Entrepreneurs, unless specifically agreed between the parties.
17.1.2 Limits of the Legal Guarantee of Conformity:
The warranty does not apply in cases of misuse, neglect or improper maintenance by the consumer.
Visible defects and damage resulting from normal wear and tear are not covered.
The consumer must notify the lack of conformity within a reasonable time after its discovery.
17.1.3 Guarantee of Hidden Defects:
Under Articles 1641 et seq. of the Civil Code, if a product has a hidden defect, the consumer may request cancellation of the sale or a price reduction. This generally requires the return of the product, unless otherwise agreed between the parties.
17.1.4 Limits of the Guarantee of Hidden Defects:
The warranty does not apply if the defect was apparent at the time of purchase.
The consumer must prove the existence of the hidden defect and demonstrate that it makes the product unfit for the use for which it is intended or that it significantly reduces its use.
The warranty claim must be made within two years of the discovery of the defect.
17.2 Specific conditions applicable to consumers residing in Mexico:
The products sold on the BeLiving store are shipped from abroad. Since BeLiving does not have a physical presence or legal entity in Mexico, and is not subject to the Federal Consumer Protection Law (LFPC), no Mexican legal warranty applies to the products sold. Any claim related to a defect or non-compliance will be reviewed on a case-by-case basis, without any commitment to process the claim, and solely at the seller's discretion.
17.3 Specific conditions applicable to consumers residing in Colombia:
The products sold on the BeLiving store are shipped from abroad. Due to the absence of a physical presence or legal entity in Colombia, BeLiving is not subject to Law 1480 of 2011; therefore, no Colombian legal warranty applies to the products sold. Any claim related to a defect or non-conformity will be reviewed on a case-by-case basis, without any commitment to process, and solely at the seller's discretion.
- Limitation of Liability:
BeLiving cannot be held liable for failure to comply with the legislation in force in the country of delivery of the products. It is the consumer's responsibility to check with local authorities the conditions for importing and using the products or services ordered.
The consumer is responsible for the use of the purchased products. BeLiving also declines all liability for damage resulting from:
- Improper use of products purchased by the consumer,
- A failure to comply with the consumer's legal or contractual obligations, particularly with regard to the declaration and payment of import taxes and duties,
-Accidents occurring during the use of the products, including but not limited to personal injury or property damage.
BeLiving warrants that the products conform to their description and are of merchantable quality, but disclaims any other implied warranties.
In the event of a dispute, BeLiving's liability is strictly limited to the amount of the order placed by the consumer, unless otherwise required by applicable law. - Protection of Personal Data:
Personal data collected on our site is used for order processing and customer relationship management. In accordance with the French Data Protection Act of January 6, 1978, you have the right to access, rectify, and delete your personal data. - Applicable Law and Disputes:
